Musician's Guide To Band Agreements

Band agreements.

If you write songs within a band, you need to plan for the day when you will be earning royalties from your songs, and be clear what will happen if a member of the band leaves or if the band splits up.
The best way to deal with this is to all agree what is fair, and then put this in writing as a formal agreement which you all sign. This way there is little chance of any comeback if the band splits for less than amicable reasons.

Here are a few specific points you should consider:


  1. If a member of the band leaves, do they forfeit all rights to the songs, and the songs remain the sole property of the band?

  2. Are the songs written by one person, or a few principal writers, who wish to retain all rights?

  3. If a band member leaves would both he and the band both retain a claim to the song, (this is probably the most likely option).

  4. How do you determine each persons share?

    Do you base it on a song by song basis ranking each members input, or use the same formula for every song.

    Do you simply divide everything up equally, (i.e. 5 members each own 20% of all the songs and therefore receives 20% of the proceeds/royalties), or do you rank each individuals input?

  5. If a member leaves, can he/she perform or profit from the music outside of the band.

Where music is written as a group effort, we recommend that you draw up an agreement to clarify issues, such as which rights belong to which member, and how royalties would be distributed in the event that members of your group leave.

For successful commercial bands, incorporation is also an option. As with a normal incorporated company, the band members would own shares in the band/company. In this situation, a band member would typically sell his shares to the other members if he decided to leave.

Music takes center stage on the heels of the official registration opening for the Nike+ Human Race, the world’s biggest one-day running event taking place on August 31, 2008.  The race brings together the power of sport and music to inspire and connect runners from every corner of the planet.  Participants in this unprecedented event will experience an exclusive music performance by some of today’s top artists in each of the 25 designated race cities.

In Los Angeles, nine-time Grammy Award winning artist Kanye West will headline the run’s post race concert for the grand finale of the 25-city Nike+ Human Race.  Runners will take to the streets passing the city’s most famous landmarks before ending at the LA Coliseum to see West take the stage.  
“I’m hitting the stage in Los Angeles for the Nike+ Human Race, Nike's dopest 10k run ever. Downloading music onto your PSP, acronym for PlayStation Portable, is quite a norm for PSP owners. However, if you are new to your gadget or are just too lazy like me to read the instruction manual, then read on for some quick tips on how to download music onto your PSP whether its already in MP3 format, or on a CD and even from iTunes. I promise you that at the end of the article, I will also show you how to find unlimited PSP downloads of music and music videos to feed your hungry PSP for peanuts. Run the PSP video converter and search and find the MP4 files you wish to convert from your PC folder, and click the Add icon in the File Menu to complete the selection. These files are ready for conversion. Select the appropriate format ie the PSP Audio Format and then execute the conversion. Your files would then be formatted and playable on your PSP.

Building a windmill does not have to be difficult. All you really need are a shop, basic power and hand tools, and of course dedication to actually get the job done. A machine in the eight to eleven foot range can be built pretty easily, and you could have it up and running in a week or two.

If you want to take a shot at building your own wind turbine, be sure to be safe and legal. Remember to make sure you are located where a windmill can be placed. Above all, find out about the zoning laws in your area. Any restrictions that might be enforced, and what you have to do in order to have a windmill where you are located should be considered. It would be a shame to get the machine up and running just to have to remove it because you did not familiarize yourself with the restrictions. Do this first, before you even make your plans for the model. Go over your plans long before you build a windmill.

Before beginning, give yourself a plan. Have an idea of what you want to accomplish. Starting with drawings or a small model of your windmill are a good idea. They do not have to be complex. As an example, think about what and how you would need to build the tower. It should be high enough for good wind strength, but heavy or grounded securely so it will not fall over. Think about looking at some manufactured designs and see how they are put together.

Of course, the materials you use depend on what you want the windmill to do, the normal weather conditions in your area, and your budget. Find out what works in windy situations, and what does not. Some people have even used scrapped car parts. Special skills might help too, such as welding, if you are working with steel or other metal material, or carving, if you are working with wood. Whatever material you choose should fit the function you want the windmill to perform. Some companies sell windmill kits you can build yourself. The key no matter what material you use is to create a sturdy machine that can withstand the wind.

The blades for the windmill can be made with wood as long as the wood is light weight. You can also use aluminum or even steel, but the steel blades might be too heavy to be practical. The length of the blades depend on the size you want your windmill to be and the height of the tower. Angle the blades like you would see on a typical household fan to collect the most wind, and taper the blades so they are thinner at the end. Three blades work the most efficiently, but you can always experiment with more. Once the windmill is completed, you will need an anchor or shaft to connect the windmill to the tower while allowing the blades to turn to face into the wind. Picture an old time weather vane on a barn to get an idea of how to attach it to the tower.

Once the windmill is completed you can connect the windmill to an alternator or generator. A windmill extracts energy from moving air by slowing the wind down and transferring the energy into a shaft, which turns your alternator or generator to create electricity. Car alternators work great for this function.

Usually power companies or wind turbine dealers have pamphlets or other literature to assist you with designing your windmill. Your windmill can be primitive and simple, yet still be an effective windmill. Have a good understanding of windmill or wind turbine design and function before you build one. It might even be a good idea to experiment first and decide if you actually want to attack the concept of building a full scale windmill. Use your creativity, ingenuity, common sense safety measures, and most importantly, have fun.

I am an avid internet user; I love the fact that there is information on almost any topic that you could think of at the tips of your fingers. Through my journeys on the information highway, I have several times come across Make money on the internet! Free and easy program, make over $2100 a day. They trickled in slowly, but lately I have noticed them more and more. Ads, banners, and junk e-mail as far as the eye can see filled with promises of making huge amounts of money, working part time hours from home.

So what is the truth? What is a scam and what is legitimate work that you can make real money with? Through some countless hours I have found some answers and insight into making money on line. First of all, if you are looking for something totally free, no money at all; then keep looking with even the most legit opportunities cost something to start up. Secondly, going into any business venture looking to get-rich-quick is unrealistic, everything takes time. Do not think that you are going to be able to retire in a few weeks, it rarely if ever happens that way.

So, you decide you want to give working on the internet a shot. There are a few things to remember. Most of what people are selling is information. There are thousands of the same sites out there that have self-created themselves as middlemen. For example, there are a lot of ads to earn money taking surveys. They advertise on average of $25 per survey that you complete. They charge anywhere from $10-$60 for a one time membership fee. But, what they do not tell you often times or bury in the fine print is that all they do is give you some tips to making money with surveys and a listing of survey sites. They do not pay you, they do not give you the surveys, and they more or less just point you in the right direction. If you keep digging a bit through the search engines you can find several free sites that offer critiques and listing of the best survey sites that pay out money. Most of the survey site, if not all offers free membership to take surveys.

Most of the data entry jobs that I looked into were all about the same things..placing ads. You pay a company anywhere from $30-$200 for them to tell you how to place pay-per-click ads. The deal with these companies is that that they are so vague, like many of the companies out there, that there is no way for you to know that all they do is give you directions and by the way most of the pay per click site have their own directions that are exactly those that the companys sell you. They also advertise that they give you access to a catalog of employers seeking data entry. What they do not tell you is that they give you a link to a FREE catalog that anyone can get by joining a site for FREE.

Say you get frustrated trying to wade through all the information, you decide to break down and pay for one of the sites that is suppose to have all the secrets. Here are a few recommendations:

1) Shop around. Often times there are 50 sites that are all selling the same thing. I ran across countless sites that were identical in appearance and text, they all where selling the same information. The highest price was $199 and the lowest was $49, chances are there is a lower price out there if you keep looking.

2) Exhaust all the free information that is out there. There are free sites or every very low priced membership. I found several site that were under $10 for membership. If you decide to pay for a membership make sure you know what you are getting with your membership and then compare to other similar sites.

3) If you have questions as to what you will get with your membership or for the price that you are payingASK. Most sites have a contact us link, use it. If they can not answer your questions directly or continue to be too vague, chances they are not selling anything new that someone couldnt find themselves.

4) Educate yourself. Do a search engine search on data entry scams, it will usually pull up articles, customer/member feedback and other free information, so you can find the right choice for you.

There are some legitimate ways to make money out there, take some time and research your options. Look for sites that offer free or reduced membership trials so you can decide if it is worth what they are asking. Also, look for programs or member sites that offer a money back guarantee and find out what the refund policy is.

If you are in pursuit of making money on the internet, you can be successful by remembering that the old adage if its too good to be true, then it usually is still rings true; even in this high tech virtual world that everyone is plugged into.

My entire life I have enjoyed most styles of music. I've been thinking about taking up a musical instrument for years. It is quite admirable to be able to express oneself musically. In fact, my last new years resolution was that I would learn to play the guitar. I have always enjoyed listening to other people play it.

When I was younger I would sing along to my favourite rock songs while strumming a mop or nearby broom. However, while I could always imagine myself strumming a melodic riff while singing my heart out, I was never quite sure if I was cut out for the learning process. I thought reaching my desired skill level would take tedious routine and lots of discipline. Not to mention the financial costs of acquiring a decent education.

Until miraculously one day a friend recommended something to me that instantly changed everything. At first I was hesitant to expect much from an online method. Yet one report alone clearly explained how to manipulate any six string beauty.

Within minutes I was understanding the guitar as never before. After a few hours I was playing along to a 1970s chart topper. Turns out one doesn't have to have years of experience to play hit songs. [ARTICLES] ADISKATE - MATT IRVING INTERVIEW

You might not know Matt Irving's name but we can guarantee you've seen or indeed own some of his handiwork. With a knack for geometric flow and a natural flair for clean lines, his style is instantly appealing and offers snippets of humour in unexpected places. From his own work under the banner of Delphi, which included some great designs for Element, and more recently one of our shoes of the year in the Milk Blazer SB, he has had his finger in more than a few pies. Right now though, he's taken on a pretty big job handling all the visuals for the embryonic adidas Skate team. From the ads to bongo vans and videos of the Gonz in full flight, Irving is all over it. The trefoil is in good hands...

How and when did you start working on adidas Skateboarding and in what capacity do you work for them?
It all started about a year ago. My friend Brett Critchlow and I were approached separately by adidas to create concepts for their ads. We were both too busy with other projects so we decided to team up and the next thing you know we got the gig and started working on it full time. We handle everything visual for adidas Skateboarding except for the actual product design. So it’s things like ad campaigns, commercials and video projects, catalogs, website design etc. Two weeks ago we were asked to redesign the paint job for a 1970s split window VW bus for adidas Brasil. Our projects can be really random at times.

What’s your overall goal with adidas Skate? Where do you want to take it?
Personally, I just want it to be sincerely focused on skateboarding and not try to be too much of a fashion thing. Just shoes for skateboarders, and if other people seem to like them, then that’s cool too. I like that the team is solid and respected by skateboarders and adidas is being very slow and steady about what shops carry the program. Being a little bit picky isn’t necessarily being exclusive and snobby, it’s about committing to the skate shops that have been around for a long time and supporting the scene.


 

How do you, in general terms as well as specifically in regards to adidas Skate, feel about non-skate companies entering
the skateboarding world?
It’s all fair game in this day and age. There aren’t any rules about who can and can’t have a skate program. I think that skating has changed a lot since I started doing it. When I was a teenager I probably would have hated it if the bigger companies were getting involved because skating was something to break away from the mainstream. These days skating isn’t what the outcast kids are doing, it’s something that is considered cool. That doesn’t mean that there is a right and a wrong, skating continually eats itself and neglects its roots.

What do you think adidas Skate can offer to skateboarding?
I think they can offer up some really good quality shoes and support some of the best skateboarders to push what is possible on a skateboard. They have a level of quality in materials and production that is much higher than most of what is out there. If they can last longer than an average pair of skate shoes, then that’s good for everyone. I think it’s also really cool that the majority of skate shoes out there have always looked to many of adidas’ classic shoe designs for how they design their shoes. Like the Shelltoe, Stan Smith, Rod Laver, Campus, Gazelle or even just the iconic stripes on a side-panel.

 
What projects are you working on right now?
I just got back from five days of filming in Berlin with the adidas Europe team. It was a really fun time and super productive. That team is so driven to get out and skate. Right now we’re out in New Zealand to shoot Mark Gonzales with a small film crew and studio. It’ll be a three minute film about Gonz out in New Zealand because he has been living out here with his lady-friend while she gives birth to their child. That happened a few weeks ago and it’s a boy.

What new product can we expect from adidas Skate in the future?
Well there’s a new hi-top style of a shoe called the Roster Mid that will be coming out in January, as well as a vulcanized version of the Campus. The Gazelle was just redesigned with subtle improvements so it’s totally skatable. I really like how that shoe turned out and it’s not going to smash the crap out of your heels because of a lack of padding. Then in the middle of 2008 there will be a redesigned Shelltoe coming back that is modeled after an original late seventies model of the shoe. It’s completely dialed in, looks amazing and is true to the style of Shelltoe everyone used to wear in the early nineties.


 

How do you juggle working for adidas and your other projects?
Lately there hasn’t been a lot of juggling actually; Brett and I have just been focused on it as much as we can so the foundation is set for this first year. I still manage to do a few outside co-op projects in the evenings but I’m making a conscious effort to dedicate more time to that sort of stuff. It’s been nice to take a break from Delphi projects and personal artwork. I think I overdid it and kind of got burnt out on work. Now it feels fun again and the ideas flow naturally, I can have a fresh approach and know that it’s art or design projects for that very sake. I can live off the adidas work and keep the personal projects focused on new ideas and personal growth.

What other projects are you working on at the moment? What about Delphi?
I did a bunch of stuff for Nike ACG before I started working for adidas. It’s a Delphi/ACG design co-op collection that drops this spring. I just wrapped up a board, sweater and tee for a German skate brand called Hessenmob. Some shirts and a jacket design for a clothing line in Paris called Sixpack and some board graphics for Element. I might actually get to have some of my photography on wine bottles for Francis Ford Coppola’s winery, but we’ll see how that turns out.


What is floating your boat at the moment? Music? Art? Drinking?

Traveling has been consistent this year and that’s always great. Going to new cities, meeting new people and seeing different art and architecture. I think it’s important to rip yourself out of the your everyday life, it’s easy to get complacent. I also get really hyped on seeing friends starting to gain acknowledgement for their artwork. It’s inspiring to see people become successful at their random ideas and eventually to a level where they can live off of it. I have a friend who shapes surfboards under the name Mandala and his impeccable craftsmanship is blowing up. I don’t really even surf, but I certainly appreciate how cool-looking his boards are and the level of quality that he demands out of himself. I like that, it’s rare!

What keeps you motivated to work in this industry? Inspires you?
I grew up skating and it kept me out of trouble. I’ve always loved it and for some reason the love hasn’t gone away. I really only enjoy working for things that I believe in, and skating happens to be one of those things. Any design work I do out of skating is usually in the streetwear realm, I only do that because I like that world too. It’s young and energetic; I just don’t like the ‘trophy-hunter’ aspect of it.


 

 

What’s your take on the current state of skateboarding and how do you feel about the constant reference of skateboarding in streetwear, despite the fact the majority of streetwear brands have little, if any, history in skateboarding?
That’s a weird one. I actually think that streetwear is loosely tied to skating because a lot of the people that run the companies tend to be skaters or ex-skaters. There’s an entrepreneurial spirit that is sort of consistent from watching skate companies come up and get successful. In many ways, streetwear of today reminds me of the skate companies in the early 90s and I think that’s why I like it.

Jamaica is an island known for its reggae music as well as its beauty. Jamaica is filled with brilliant color and flavor. This is truly evident in the diversity of its people, beaches, food, and its music.

Jamaicas music has moved through many different variations. We have heard and seen performances of rhythms such as Dub, Ska, Congo, and Dancehall. All of these rhythms are known across the world as reggae. This music is a combination of African, American, Blues, and Jamaican folk rhythms. Though this style of music is original only to Jamaica, it is known and loved globally. This music had its origin with ska in the late 1950s right about the time Jamaica got its independence from England.

It all started with the sound systems, and the massive open-air discos that established themselves on the streets of Kingston, Jamaica. It was in the 1970s that the late Bob Marley took this art and made it an international craze with roots reggae, which was a heavy, spiritual and conscious sound. In 2002 Bob Marleys album Exodus won album of the century. This proud, bold island had now made its mark on the world first because of its music.

In the 1990s dancehall and reggae evolved, accompanied by the opinion that it contained more offensive lyrics that would encourage street violence and dismay. However, recently I have seen and heard a recent development going back to more socially and spiritually aware lyrics known by some to be the New Roots Movement. I find that this is a good turn for music in Jamaica and the rest of the world. One of the leading producers in Jamaica, Boby Digital, said:

If you feed people with violence theyre going to be vile. If you fill them with love, theyre going to be lovely.

Today you can see the great performances as the artists are showcased at events such as the Caribbean Music Expo, and Jamaica Sumfest. New Reggae artists such as Shaggy, Sean Paul, and Abijah have brought reggae even further internationally. These events usually take place on the north coast (i.e. Ocho Rios, Runaway Bay, Montego Bay, Discovery Bay) of Jamaica, and sometimes the south coast such as Negril, Jamaica.

It is highly recommended that those who are truly interested in Jamaicas culture and music attend one of these shows. Some of these stage shows can be days long, so if you cant be there for the entire show, you can catch at least one day of it.

PR professionals have taken a lot of heat lately for the ways they pitch stories to bloggers. Some bloggers do not want to be solicited to by PR companies and their stance is understandable.

However, PR does serve a valuable purpose in business and it is certainly not going to disappear in the new media landscape. In this post, I will describe essential elements of a stellar PR pitch to a blogger.

I received an email today from a PR professional this morning that illustrated 8 essential aspects to include whenever pitching bloggers. Here are the good things this professional remembered that too many journalists and PR folks forget:
  1. Short: The total email was 130 words long. Already, this sends the message that she respects my time.
  2. Introduction: In one sentence, she explains who she is, who the client is, and why she is writing to me.
  3. Description: Again in one sentence, she sums up the product with a minimum of the adjectives that decrease believability (best, great, unique, etc).
  4. Seduction: I would have made the mistake of describing at least one feature or benefit. Instead, Christina piques my interest just enough and then leaves me two links from which to garner the specs. I had clicked these links before I even finished reading the email.
  5. Help: Another one-sentence reminder that I can contact her with any questions.
  6. Thanks: She ends by acknowledging my limited time and thanking me for reading. Even if it sounds heavy handed (which it does not), the blogger is getting his/her ego stroked and that never hurts.
  7. Transparency: The postscript is not only transparent by again mentioning the client, but also encourages transparency if I write about it. This mentality builds trust.
  8. Tone: The tone is helpful, but reserved (not one exclamation point!).
If your copywriting follows these simple rules, you cannot help but improve your response from bloggers. In the end, it comes down to being respectful, professional, and sounding like a human being. (It turns out people prefer other people rather than PR robots. Who knew?)
